Mutterschaft, Stillen, Beruf… wie l\u00e4sst sich das alles vereinbaren? Das luxemburgische Recht gibt eine klare Antwort: Stillen am Arbeitsplatz ist kein Privileg, sondern ein Recht.<\/p>\n\n\n\n

Die Regelung zur Stillzeit ist in Artikel 336-3 des luxemburgischen Arbeitsgesetzbuches festgelegt. Konkret bedeutet dies, dass Sie auf Antrag Anspruch auf Stillzeit w\u00e4hrend Ihres Arbeitstages haben. Diese umfasst zwei Zeitr\u00e4ume von jeweils 45 Minuten, einen zu Beginn und einen am Ende Ihrer regul\u00e4ren Arbeitszeit.<\/p>\n\n\n\n

Wenn Ihr Arbeitstag nur durch eine einst\u00fcndige Pause unterbrochen wird, k\u00f6nnen diese beiden Zeitr\u00e4ume zu einer einzigen Stillzeit von 90 Minuten zusammengefasst werden. Diese M\u00f6glichkeit besteht auch, wenn Sie Ihr Kind nicht in der N\u00e4he Ihres Arbeitsplatzes stillen k\u00f6nnen.<\/p>\n\n\n\n

Zu beachten: Diese Zeit gilt als tats\u00e4chliche Arbeitszeit und wird normal verg\u00fctet.<\/strong><\/p><\/div><\/div><\/div>\n\n\n\n

Um diese Stillzeit in Anspruch nehmen zu k\u00f6nnen, m\u00fcssen Sie einen schriftlichen Antrag bei Ihrem Arbeitgeber stellen. Das Gesetz legt keine bestimmte Frist fest: Sie k\u00f6nnen den Antrag also jederzeit stellen, sobald Sie dieses Recht in Anspruch nehmen m\u00f6chten.<\/p>\n\n\n\n

Au\u00dferdem ist in den Gesetzestexten keine Verpflichtung zur Vorlage eines \u00e4rztlichen Attests vorgesehen. In der Praxis kann der Arbeitgeber jedoch ein \u00e4rztliches Attest verlangen, das das Stillen best\u00e4tigt. In diesem Fall m\u00fcssen Sie lediglich einen entsprechenden Antrag bei Ihrem Arzt stellen und das Dokument Ihrem Arbeitgeber vorlegen.<\/p>\n\n\n\n

Ich arbeite in Teilzeit. Muss die Stillzeit, auf die ich Anspruch habe, proportional zu meiner Arbeitszeit gek\u00fcrzt werden?<\/h4><\/path><\/svg><\/div>

Die Antwort auf diese Frage h\u00e4ngt von Ihrer t\u00e4glichen Arbeitszeit ab. Denn die Dauer und H\u00e4ufigkeit der Stillzeit, die in Artikel L.336-3 garantiert ist, sind f\u00fcr einen \u201enormalen Arbeitstag\u201d vorgesehen. In Luxemburg betr\u00e4gt der normale Arbeitstag 8 Stunden.<\/p>\n\n\n\n

Ausgehend von dieser Feststellung gilt Folgendes:<\/p>\n\n\n\n

Wenn Sie in Teilzeit arbeiten und dabei 8-Stunden-Tage leisten, haben Sie je nach Ihrer Situation Anspruch auf 2 x 45 Minuten oder 90 Minuten Stillzeit.<\/p>\n\n\n\n

Beispiel: Eine Arbeitnehmerin arbeitet montags, dienstags, donnerstags und freitags zu 80 % und leistet volle Arbeitstage (8 Stunden): Sie hat Anspruch auf eine Stillzeit von 2 x 45 Minuten oder 90 Minuten, je nach ihrer Situation.<\/p>\n\n\n\n

Wenn Ihre Arbeitstage weniger als 8 Stunden dauern, muss Ihre Stillzeit anteilig berechnet werden. Hier finden Sie eine \u00dcbersichtstabelle mit der Ihnen zustehenden Stillzeit, abh\u00e4ngig von Ihrer t\u00e4glichen Arbeitszeit:<\/p>\n\n\n\n

Wenn eine Arbeitnehmerin in Teilzeit arbeitet und ihre Arbeitszeiten von Tag zu Tag variieren, wird die Stillzeit an die an diesem Tag geleistete Arbeitszeit angepasst.<\/p>\n\n\n\n

Beispiel: Eine Arbeitnehmerin arbeitet zu Beginn der Woche ganzt\u00e4gig 8 Stunden und am Mittwoch einen halben Tag 4 Stunden. Ihre Stillzeit wird entsprechend angepasst: Sie entspricht der einer Vollzeitbesch\u00e4ftigten f\u00fcr die 8-Stunden-Tage und ist am Mittwoch auf 45 Minuten begrenzt.<\/p>\n<\/div><\/div>\n\n\n\n

Ist das Recht auf diese Stillzeit an eine bestimmte Betriebszugeh\u00f6rigkeit gekn\u00fcpft?<\/h4><\/path><\/svg><\/div>

Nein, das Recht auf Stillpausen h\u00e4ngt von der Situation der stillenden Mutter ab und nicht von ihrer Betriebszugeh\u00f6rigkeit.<\/p>\n\n\n\n
